Sales Terms & Conditions – Personal SOS Alarm (United States)

1. Agreement to Terms

These Terms & Conditions (“Terms”) govern the sale of personal SOS alarm devices (“Product”) by Medi Connect US (“Company,” “we,” “us,” or “our”) through our website, phone, or other sales channels. By purchasing or using the Product, you (“Customer,” “you,” or “your”) agree to these Terms.

2. Important Safety Notice
  • The Product is intended as a personal alert and communication device only.
  • When activated and if a connection is successfully established, our monitoring system will assess the situation and may contact local emergency services if deemed necessary.
  • We will use reasonable efforts to relay information to emergency responders.
  • We do not guarantee that emergency services will respond, that responders will arrive in time, or that the Product will prevent injury, harm, or loss.
  • You are solely responsible for seeking emergency assistance directly by dialling 911 if you are able.
3. Orders and Acceptance
  • Your order is an offer to purchase the Product, subject to our acceptance.
  • We may accept, reject, or cancel orders at our discretion, including for availability, errors, or suspected fraud.
  • An order is binding only once we issue written or electronic confirmation.
4. Prices and Payment
  • Prices are listed in U.S. dollars unless otherwise stated.
  • We may update prices before acceptance of your order.
  • Sales tax and applicable fees will be added as required by law.
  • Payment is required at the time of purchase using approved payment methods.
5. Shipping, Delivery, and Risk of Loss
  • Shipping methods, costs, and estimated delivery times are provided at checkout. Delivery dates are estimates only.
  • Title and risk of loss transfer to you when the Product is delivered to the carrier.
  • You must inspect the Product promptly and notify us within 14 days of any defects, shortages, or damage.
6. Returns and Refunds
  • Returns are accepted within 30 days of delivery, in line with our Return Policy.
  • Returned Products must be in original condition, unused, and include proof of purchase.
  • Unless due to our error, you are responsible for return shipping costs.
  • Refunds are issued to the original payment method after inspection and approval.
7. Product Information and Use
  • The Product relies on wireless networks, location services, and third-party providers. Coverage and availability may vary and are outside of our control.
  • Proper use requires activation, a functioning connection, and adherence to the provided instructions.
  • We cannot guarantee uninterrupted or error-free operation, or that emergency services will always be reachable through the Product.
8. Limited Warranty and Disclaimers
  • The Product includes a limited warranty against defects in materials and workmanship for 12 months from the purchase date.
  • Except as expressly stated, the Product is provided “as is.”
  • To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose.
  • Some states do not allow such limitations, so these may not apply to you.
9. Limitation of Liability
  • To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or special damages, including personal injury, property damage, death, or loss of data, arising from use or inability to use the Product.
  • We are not liable for delays, failures, or inability to connect to emergency services, or for the response (or lack thereof) by emergency responders.
  • Our total liability shall not exceed the amount you paid for the Product.
  • Some states do not allow exclusions of certain damages, so these may not apply to you.
10. Indemnification

You agree to indemnify and hold harmless Medi Connect US, its affiliates, officers, employees, and agents against claims, damages, or expenses resulting from your misuse of the Product or violation of these Terms.

11. Governing Law and Dispute Resolution
  • These Terms are governed by U.S. federal law and, where applicable, the laws of the state where we are headquartered.
  • You agree to submit to the jurisdiction of courts located in our principal place of business, except where state consumer laws require otherwise.
  • Nothing in these Terms affects your non-waivable state consumer rights.
12. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, government actions, labor disputes, or supply chain disruptions.

13. Severability

If any part of these Terms is found unenforceable, the remaining provisions remain in effect.

14. Entire Agreement

These Terms constitute the entire agreement between you and us regarding your purchase and supersede all prior understandings or agreements.

15. Changes to Terms
We may update these Terms periodically. The version in effect at the time of your order will apply.
